Selectmen Approve New Stadium Liability Policy

The approval means the scheduled concerts will likely go on as planned.

A months long issue with insurance has come to an end in Foxborough, much to the relief of everyone involved and concertgoers everywhere.

With a vote of 4-0, the Foxborough Board of Selectmen approved the licenses for the Bon Jovi, Taylor Swift, and Kenny Chesney concerts on the conditions that the town was able to obtain a liability insurance for town employees that brings the town’s deductible back down to $7,500 per a successful claim.

Jim DeVellis was unable to attend the meeting as he noted at the selectmen’s July 9 meeting.

Under the new plan, the town’s insurance provider MIIA will bring the deductible back down from $50,000 to $7,500 per a claim. The Kraft Group has also strengthened it's own civil rights coverage, making it closely resemble the town's civil rights coverage. 

Gillette Stadium will remain responsible for the action of their own security during events and the town will maintain responsibility over the actions police officials working stadium events.

According to Foxborough’s insurance counsel John Davis, all that remains is some minor cleanup on the language on the policy and the obtaining of signatures from Great Divide personnel which is expected to take place on July 12.

Once the final touches are placed on the policy, the town will issue the entertainment licenses.

For the New England Revolution match against the Houston Dynamo on July 13, the policy will be in effect without the signatures but they will be needed for the concerts.

The vote ends weeks of frantic discussions and negotiations between the town and the Kraft Group on the town’s liability insurance.

Thanking both town and Kraft Group officials for their work, chairman Mark Sullivan briefly addressing the exchanges from the previous meetings between the two sides.

"Everyone wanted to get to the same point it just didn’t seem that way at some points. It was just a difference in agreement," Sullivan said. "We appreciate everything they (Kraft Group) do for the community of Foxboro. When we have to butt heads we try to do it as softly as possible." 

The first concert of the year will take place on July 20 when Bon Jovi plays at Gillette Stadium along with the J. Geils Band.
