Foxborough Police Chief: No Update on Condition of Boy Struck by Truck Monday

Foxborough Police Chief Edward O'Leary says he has not received any update on the condition of the boy who was struck by a landscaping truck while riding his bike on Baker Street Monday.

"We haven't had any update at all from the mom about the status of the child," O'Leary said. 

The boy reportedly suffered head trauma, internal injuries and several skin abrasions from the accident, according to Foxborough Police and was transported by MedFlight to Tufts Medical Center in Boston.

O'Leary did say he heard from "unreliable" sources the boy was in ICU at Tufts Medical Center Monday night.

"Last I had heard through, unreliable other parties, is that he did undergo some type of surgical procedure and had been in the ICU by Monday evening," O'Leary said.

The operator of the 2010 Dodge Ram dump truck that struck the boy was identified as Sean Fitzgerald, 28, of 434 South St., Foxborough. The vehicle involved in the accident is registered to J.Jerome Landscaping Services of North Easton.

Fitzgerald was transported to the Foxborough Police Department Monday for questioning and was "subsequently released and no charges are pending," according to a press release issued by Foxborough Police.

"A member of the Massachusetts State Police Commercial Enforcement Section assisted in the investigation and cited Mr. Fitzgerald for a commercial vehicle infraction," the press release said. "Mr. Fitzgerald was not cited for any moving or traffic violation in regards to the crash. The owner of the vehicle was cited for vehicle safety infractions."

While there are no criminal charges pending against Fitzgerald, the investigation into the cause of this accident is "ongoing," according to the press release.

As of Wednesday, O'Leary said there was nothing new to report regarding the investigation.

"The state police are still analyzing the data points they obtained through their accident reconstruction," O'Leary said.
